General Terms and Conditions of ACR Drivers Club
This document contains the General Terms and Conditions of ACR Drivers Club, the organiser of rallies, drives and tours for performance cars. By registering for an event, the participant confirms that they agree to these Terms and Conditions.
Article 1: Definitions
ACR Drivers Club: the sole proprietorship with limited liability, also operating under the names ACR Drivers Club, ACR, and Lux Consultancy, located at Burgemeester van Heugtenlaan 84, 2911 HA Nieuwerkerk aan den IJssel, the Netherlands, registered with the Dutch Chamber of Commerce under number 80269753.
Participant: the natural person or legal entity registering for an event through the ACR Drivers Club website.
Parties: ACR Drivers Club and the Participant jointly.
Agreement: the distance agreement between ACR Drivers Club and the Participant regarding participation in an event.
Event: an activity organised by ACR Drivers Club.
Vehicle: a vehicle participating in an event.
Visual Material: photographs, videos and other visual media.
Website: the domain name https://www.audicompetitionrally.com and any associated subdomains.
Terms and Conditions: these terms and conditions applicable to all agreements and services provided by ACR Drivers Club.
Article 2: Applicability
These Terms and Conditions apply to all legal relationships between ACR Drivers Club and the Participant.
These Terms and Conditions remain applicable even if ACR Drivers Club engages subcontractors or third parties.
If any provision of these Terms and Conditions is declared void or unenforceable, the remaining provisions shall remain fully effective. A replacement provision shall be adopted that reflects the original intent as closely as possible.
ACR Drivers Club reserves the right to amend these Terms and Conditions. Any changes will be communicated to users through the Website or by another appropriate method.
Article 3: Registration and Agreements
Registration is only possible through the ACR Drivers Club website, whereby the Participant must provide accurate and complete information.
The minimum age for participation as a driver is 18 years. No minimum age applies to passengers or children.
Participants guarantee that the information provided is accurate and up to date and are obliged to communicate any changes in a timely manner.
ACR Drivers Club reserves the right to refuse registrations within 10 working days.
An Agreement is established once the registration has been approved by ACR Drivers Club.
Article 4: Communication and Information Provision
All communications to Participants will be sent by email, post, or WhatsApp.
Upon purchasing an event entry ticket, Participants will automatically receive updates regarding upcoming events. Participants may unsubscribe from these updates at any time.
Article 5: Additional Activities
ACR Drivers Club may offer additional activities, which may or may not be included in the base price of an Event.
For additional activities, a full description and price quotation will be provided.
ACR Drivers Club reserves the right to cancel or modify additional activities in the event of force majeure, adverse weather conditions, or limited availability.
Article 6: Legislation, Regulations and Insurance
Participants must comply with all applicable laws and regulations, including traffic laws and safety requirements.
During the Event, Participants must possess a valid driving licence and vehicle registration.
Required insurance coverage includes:
Third-party liability insurance;
Personal injury and death insurance;
Health insurance;
Insurance covering damage to property and third parties.
Article 7: Organisation
ACR Drivers Club organises Events according to professional standards and makes every effort to ensure proper execution.
The organisation may outsource parts of the Agreement to third parties.
In the event of unforeseen circumstances, the Event schedule may be adjusted, including changes to booked hotels.
Article 8: Right of Withdrawal
The Participant has a 14-day cooling-off period during which they may terminate the Agreement without providing a reason.
The cooling-off period starts once the deposit has been received by ACR Drivers Club.
If the Participant exercises their right of withdrawal within the applicable period, the amount paid will be fully refunded.
Free cancellation is possible up to 31 days before the start of the Event.
Article 9: Stickers and Sponsors
Applying the ACR Drivers Club sticker package is optional but highly appreciated.
ACR Drivers Club is not liable for any damage resulting from the application or removal of stickers.
Article 10: Participant Code of Conduct
Participants must follow all instructions provided by ACR Drivers Club and ensure their own safety and the safety of others.
The use of alcohol, drugs, fireworks, weapons, or dangerous objects during an Event is strictly prohibited.
Engaging in speed contests, racing, or any other form of competition with other Participants is not permitted.
Article 11: Refusal of Participation
In the event of a breach of these Terms and Conditions, ACR Drivers Club may refuse or terminate a Participant’s participation.
The Participant is fully liable for any damage resulting from violations of these Terms and Conditions.
Article 12: Visual Material
ACR Drivers Club may record Events and use this material for publication purposes, including editing and adding names or audio.
Participants transfer the copyrights to Visual Material created during Events to ACR Drivers Club without entitlement to additional compensation.
Article 13: Payment
Participants must make payment in advance through the Website to confirm their participation.
Once the Agreement has been concluded, the Participant will receive an invoice from ACR Drivers Club.
Participation fees or other costs may be paid by bank transfer, online banking, or another accepted method of payment.
ACR Drivers Club applies appropriate security measures for electronic payments.
The Participant must pay the invoice within the payment period stated on the invoice. If no payment period is specified, a payment term of fourteen (14) days from the invoice date applies.
Article 14: Intellectual Property
All rights to materials produced by ACR Drivers Club remain the exclusive property of ACR Drivers Club.
Article 15: Participant Risk
Participants are responsible for lost, stolen, or damaged personal belongings and vehicles during Events.
ACR Drivers Club accepts no liability for accidents, incidents, calamities, or injuries occurring during Events.
Article 16: Termination and Cancellation
ACR Drivers Club may terminate the Agreement unilaterally in the event of a breach of these Terms and Conditions or applicable laws.
Cancellations by Participants must be submitted in writing by email or via WhatsApp.
Cancellation fees:
Up to 30 days before the Event: free of charge.
Between 29 and 13 days before the Event: 50% of the total amount.
Within 13 days before the Event: 100% of the total amount.
Article 17: Liability
ACR Drivers Club is only liable for damages resulting from gross negligence or intentional misconduct.
Liability is limited to the amount paid out under ACR Drivers Club’s liability insurance.
Article 18: Force Majeure
ACR Drivers Club shall not be responsible for failure to fulfil obligations caused by unforeseen circumstances beyond its reasonable control.
Article 19: Applicable Law and Disputes
All Agreements are governed exclusively by Dutch law.
Any disputes shall be submitted exclusively to the competent court in Rotterdam, the Netherlands.
